Organization Started Under The Marrakesh Agreement
1. The General Council is taking appropriate steps to ensure effective cooperation with other intergovernmental organizations linked to those of the WTO. 2. The Ministerial Conference and the General Council are exclusively empowered to issue interpretations of this agreement and multilateral trade agreements. If a multilateral trade agreement is interpreted in Schedule 1, they exercise their powers on the basis of a Council recommendation that controls the operation of this agreement. The interpretive decision is taken by a majority of three-quarters of the members. This paragraph cannot be used in a way that would compromise the provisions amending Article X. 3. Amendments to the provisions of this agreement or multilateral trade agreements in Schedules 1A and 1C, which are not listed in paragraphs 2 and 6 and which would change the rights and obligations of members, will come into effect for members who have adopted them after adoption by two-thirds of members and subsequently for any other member after your adoption. The Ministerial Conference may decide, with three-quarters of the members, that any amendment that has come into force under this paragraph is such that any member who has not accepted it within a time frame set by the Ministerial Conference is free to withdraw from the WTO or to remain a member with the agreement of the Ministerial Conference. 3.
The agreements listed in Schedule 4 and related legal instruments (so-called multilateral trade agreements) are also part of this agreement for the members who have adopted them and are binding on those members. Multilateral trade agreements do not create obligations or rights for Members who have not accepted them. 3. Paragraph 1 applies between a member and another member who has joined under Article XII only if the member who does not accept the application has informed the Ministerial Conference of the terms of membership before the agreement is approved by the Ministerial Conference. 1. Unless otherwise stated under this agreement or multilateral trade agreements, the WTO draws on the simplified decisions, procedures and practices followed by the 1947 GATT treaties and the bodies created under the 1947 GATT. 9. At the request of the parties to a trade agreement, the Ministerial Conference may decide by mutual agreement to include this agreement in Schedule 4. At the request of the parties to a multi-lateral trade agreement, the Ministerial Conference may decide to remove this schedule 4 agreement.
The conditions set out in this agreement and in multilateral trade agreements must be understood by a separate member of WTO customs territory. 2. Membership decisions are made by the Ministerial Conference. The Ministerial Conference approves the agreement on the terms of membership by a two-thirds majority of WTO members. (2) The WTO provides the status of negotiations among its members on multilateral trade relations in the cases under this agreement. The WTO can also provide a forum for further negotiations among its members on their multilateral trade relations and a framework for the implementation of the outcome of these negotiations, as decided by the Ministerial Conference. (8) The bodies under the multilateral trade agreement fulfil the tasks entrusted to them under these agreements and operate within the institutional framework of the WTO. These bodies regularly keep the General Council informed of their activities. 2. The agreements and related legal instruments, known as multilateral trade agreements, which are contained in Schedules 1, 2 and 3, are an integral part of this agreement and are binding on all members.
